Probate administration is a court process through which the estate of the deceased—with all assets in their name and with no designated beneficiaries—remains open to manage the deceased one’s affairs. Probate involves the identification, organization, and distribution of one’s assets after death. It also requires that the any beneficiaries and creditors be notified of their death. This administration will also determine which persons receive which assets, whether the deceased executed a last will and testament, and whether the deceased is survived by a spouse or child(ren). If there is no will outlining his or her wishes after death, the deceased’s assets will be distributed to surviving family members. However, if there is no will and no family to inherit their assets, then the assets will pass to the state of Florida.
